PocketGST Terms of Service

1. Introduction and Acceptance of Terms

Welcome to PocketGST, a mobile application for GST calculation and invoice management ("App" or "Service"), owned and operated by QalbIT Infotech Private Limited ("QalbIT," "we," "us," or "our"), a company incorporated under the Companies Act, 2013, with its registered office in Gujarat, India.

By downloading, installing, accessing, or using PocketGST, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately discontinue use of the App.

Important: These Terms constitute a legally binding agreement between you and QalbIT Infotech Private Limited. Please read them carefully.

2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 18 years of age or the age of majority in your jurisdiction to use PocketGST. By using the App, you represent and warrant that you meet this age requirement.

2.2 Business Use

PocketGST is intended for use by individuals, sole proprietors, freelancers, small and medium-sized businesses, chartered accountants, and other professionals for legitimate business purposes related to GST compliance and invoice management in India.

2.3 No Account Required (Free Tier)

PocketGST's Free tier does not require account creation or signup. You may use the offline features without providing personal information.

2.4 Account Creation (Pro Tier)

To access Pro tier features, including cloud backup to your Google Drive, you may be required to authenticate through Google Play Billing, Apple App Store, or grant access to your Google Drive. You agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security of your account credentials
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access or security breach

3. Service Description and License

3.1 What PocketGST Provides

PocketGST is a mobile application that provides:

GST calculation tools (Add GST, Remove GST, multi-item calculations)
Invoice creation and management
Offline HSN/SAC code lookup (no internet required)
Offline GSTIN validation (checksum verification, no live API validation)
PDF invoice generation and sharing
Business profile and customer management
Data export capabilities (Pro tier)
Cloud backup to user's own Google Drive (Pro tier)

3.2 License Grant

Subject to your compliance with these Terms, QalbIT grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

Download and install the App on devices you own or control
Access and use the App for your internal business purposes

3.3 License Restrictions

You may NOT:

Copy, modify, distribute, sell, or lease any part of the App
Reverse engineer, decompile, or attempt to extract the source code
Remove, obscure, or alter any proprietary notices or branding
Use the App for any unlawful purpose or in violation of these Terms
Circumvent or disable any security features or usage limits
Use the App to transmit viruses, malware, or harmful code
Interfere with or disrupt the integrity or performance of the App
Access the App through automated means (bots, scrapers, etc.) without permission
Resell, sublicense, or distribute access to the App to third parties
Use the App to create a competing product or service

4. Free Tier and Pro Tier Features

4.1 Free Tier

The Free tier includes:

Up to 15 GST-compliant invoices per month
Unlimited GST calculator access (offline)
Unlimited customer/party records (stored locally)
Offline HSN/SAC code lookup (limited database, offline mode)
Offline GSTIN validation (checksum verification only, no live government API validation)
Calculation and invoice history (stored locally until manually deleted by user)
Single device access
Local (offline) data storage only
PDF invoice generation with "Made with PocketGST" watermark
3 basic invoice templates

Free Tier Limitations:

Data is stored locally on your device only
No cloud backup or multi-device sync
No data export (CSV/Excel)
Watermark cannot be removed from invoices
HSN/SAC database is limited (full database available in Pro)
GSTIN validation is offline only (checksum validation, not live status check)
History is retained until you manually delete it (no automatic retention period)

4.2 Pro Tier

The Pro tier unlocks:

Unlimited invoices per month
Removal of "Made with PocketGST" watermark
15+ professional invoice templates
Full offline HSN/SAC database (22,000+ codes)
Offline GSTIN validator with batch capability (checksum verification)
Calculation and invoice history (unlimited, stored locally and in your Google Drive)
Cloud backup to your own Google Drive (user-controlled)
Multi-device access (up to 5 devices, synced via your Google Drive)
CSV/Excel data export
E-invoicing with IRN (Invoice Reference Number) generation
Support for up to 3 GSTINs
UPI QR code support on invoices
Priority customer support
Ad-free experience

4.3 Important Service Clarifications

GSTIN Validation: PocketGST provides offline GSTIN validation based on checksum verification and format validation only. This is NOT a live check against the government GST portal. The App verifies that a GSTIN follows the correct 15-character format and passes checksum rules, but it does not confirm:

Whether the GSTIN is currently active or valid with GSTN
Whether the business name matches the GSTIN
The real-time status of the GSTIN registration

For live GSTIN validation, you must check directly with the official GST portal at https://services.gst.gov.in/. QalbIT is not responsible for any errors or consequences arising from reliance on offline GSTIN validation.

Cloud Backup (Pro Tier): Cloud backup in PocketGST is stored in your own Google Drive account, not on QalbIT's servers. This means:

You control your data storage and security
QalbIT does not have access to your Google Drive data
You are responsible for maintaining adequate Google Drive storage space
Data security depends on your Google account security practices
If you revoke PocketGST's access to Google Drive, cloud backup will stop working

4.4 Feature Availability

QalbIT reserves the right to modify, suspend, or discontinue any features (free or paid) with reasonable notice, except where such changes would materially diminish the core functionality promised to paying Pro users.

5. Subscription Plans and Pricing

5.1 Pro Tier Pricing

Pro tier is available through the following subscription options:

All prices are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

5.2 Payment Processing

Payments are processed exclusively through:

Google Play Billing (for Android users)
Apple App Store In-App Purchase (for iOS users, when available)

You authorize QalbIT and its payment processors to charge your selected payment method for all fees incurred under your account.

5.3 Subscription Auto-Renewal

Monthly and Yearly subscriptions automatically renew unless you cancel before the renewal date. You will be charged the then-current subscription price at each renewal.

To cancel auto-renewal:

For Google Play: Open Google Play Store → Menu → Subscriptions → PocketGST → Cancel Subscription
For Apple App Store: Settings → [Your Name] → Subscriptions → PocketGST → Cancel Subscription

Cancellations take effect at the end of the current billing period. You retain Pro access until that date.

5.4 Lifetime Plan

The Lifetime plan is a one-time payment granting perpetual access to Pro tier features as they exist and evolve, subject to these Terms. Lifetime access is:

Non-transferable
Non-refundable (see Section 6)
Limited to the original purchaser
Subject to QalbIT's continued operation of the Service

5.5 Price Changes

QalbIT reserves the right to change subscription prices with 14 days' advance notice. Notice will be provided via:

In-app notification
Email (if you have provided account email)
Announcement on our website

Price changes apply to:

New subscriptions purchased after the notice period
Renewals of existing subscriptions after the notice period

If you have an active subscription at the time of a price change, the new price will apply at your next renewal date (after the 14-day notice period expires). You may cancel before renewal to avoid the price increase.

5.6 Taxes

All prices listed are inclusive of applicable GST (Goods and Services Tax) as per Indian tax laws. If you are located outside India, additional taxes may apply based on your jurisdiction.

6. Refund and Cancellation Policy

6.1 No Refund Policy

ALL SALES ARE FINAL. QALBIT DOES NOT OFFER REFUNDS FOR ANY PURCHASES.

This no-refund policy applies to:

Monthly subscriptions
Yearly subscriptions
Lifetime purchases
All in-app purchases
Purchases made through Google Play Billing or Apple App Store

By purchasing Pro tier, you acknowledge and agree that:

You will not receive a refund under any circumstances
You have reviewed the feature list and understand what you are purchasing
You accept full responsibility for your purchase decision

6.2 Exceptions (Platform-Mandated Refunds Only)

The only exceptions to our no-refund policy are refunds mandated by:

Google Play Store policies (if Google determines a refund is required)
Apple App Store policies (if Apple determines a refund is required)
Indian consumer protection laws (if legally mandated by a court or consumer forum)

In such cases, refunds will be processed according to the platform's or legal authority's requirements. QalbIT reserves the right to terminate your access to Pro tier if a refund is issued.

6.3 Cancellation Process

You may cancel your Pro subscription at any time to stop future charges. Upon cancellation:

You retain Pro access until the end of the current paid period
No refund will be issued for the unused portion of your subscription
Your account automatically downgrades to Free tier after expiration
Your local data remains on your device
Your Google Drive backup (if enabled) remains in your Google Drive (QalbIT does not delete it)

To cancel, follow the instructions in Section 5.3.

6.4 Account Termination by QalbIT

If QalbIT terminates your account due to violation of these Terms, you forfeit all paid subscription fees with no refund.

7. Data Ownership, Privacy, and Security

7.1 Your Data Ownership

You retain all rights, title, and interest in your data (invoices, calculations, customer records, business information, etc.) created or stored in PocketGST. QalbIT does not claim ownership of your data.

7.2 How We Collect and Use Data

Free Tier (Offline-Only):

Your data is stored locally on your device only
QalbIT does not have access to your invoices, calculations, or business records
No account or personal information is collected for Free tier usage
History data is retained on your device until you manually delete it

Pro Tier (User-Controlled Cloud Backup):

When cloud backup is enabled, your data is stored in your own Google Drive account
QalbIT does not store your data on our servers
QalbIT does not have access to your Google Drive data
You control backup, sync, and deletion of data in your Google Drive
We collect minimal account information (Google account email for authentication) for Pro tier access
We may collect usage analytics (anonymized) to improve the App, only if you opt-in

Both Tiers:

Device information (OS version, device model) for compatibility and crash reporting
App usage data (anonymized) for feature improvement, only if you opt-in to analytics

7.3 Google Drive Integration (Pro Tier)

When you enable cloud backup in Pro tier:

You grant PocketGST permission to access your Google Drive for backup purposes only
PocketGST creates a dedicated folder in your Google Drive to store encrypted backup files
You can revoke this permission at any time through your Google Account settings
Revoking permission will disable cloud backup and multi-device sync
QalbIT cannot access, view, or modify your other Google Drive files

Your Responsibilities:

Maintain adequate Google Drive storage space for backups
Protect your Google account credentials
Understand that Google Drive's terms of service apply to your backup data
Monitor your Google Drive for backup file integrity

7.4 Data Security

QalbIT implements industry-standard security measures to protect your data, including:

Encryption for data stored in Google Drive backups (Pro tier)
Secure authentication via Google OAuth for Google Drive access
Regular security audits and updates

However, no system is 100% secure. You acknowledge that:

Data stored on your device is subject to your device's security
Data stored in your Google Drive is subject to Google's security practices
You use the App at your own risk
QalbIT cannot guarantee absolute security

7.5 No Access to Payment Data

QalbIT does not store your credit card, debit card, UPI, or bank account details. All payments are processed by Google Play or Apple App Store. QalbIT receives only transaction confirmation and receipt information necessary for subscription management.

7.6 Data Retention

Free Tier:

Local data is retained on your device until you manually delete it or uninstall the App
QalbIT does not store your data on our servers
No automatic deletion or retention period applies

Pro Tier:

Local data is retained on your device as in Free tier
Google Drive backup data is retained in your Google Drive account indefinitely (unless you delete it)
After subscription cancellation or expiration, you retain access to your Google Drive backups (they are in your account)
QalbIT does not delete your Google Drive backups when your subscription expires

Data Deletion Requests: To delete your data:

Local data: Uninstall the App or use in-app data deletion options
Google Drive backups: Manually delete the PocketGST folder from your Google Drive

Legal Obligations: We may retain minimal transaction records (purchase receipts, subscription status) as required by Indian tax and accounting laws.

8. Acceptable Use and Prohibited Conduct

8.1 Permitted Use

You may use PocketGST to:

Create GST-compliant invoices for legitimate business transactions
Calculate GST for goods and services in accordance with Indian GST laws
Manage customer records and business profiles
Generate reports for internal business use and tax filing

8.2 Prohibited Use

You may NOT use PocketGST to:

Create fraudulent, fake, or misleading invoices
Evade taxes or assist others in tax evasion
Violate any applicable laws, including GST Act, Income Tax Act, or other Indian regulations
Harass, abuse, or harm others
Impersonate any person or entity
Transmit spam, unsolicited communications, or promotional material
Infringe intellectual property rights of QalbIT or third parties
Upload or share malicious code, viruses, or harmful content
Engage in unauthorized commercial activity (e.g., reselling the App)

8.3 Consequences of Violation

Violation of these Terms may result in:

Immediate suspension or termination of your account
Forfeiture of paid subscription fees (no refund)
Legal action, including criminal complaints or civil lawsuits
Reporting to law enforcement or tax authorities if illegal activity is suspected

9. Intellectual Property Rights

9.1 QalbIT's Ownership

PocketGST, including its design, code, algorithms, user interface, branding (logos, trademarks, "PocketGST" name), and all related intellectual property, is owned exclusively by QalbIT Infotech Private Limited or its licensors.

9.2 Trademarks

"PocketGST," the PocketGST logo, and other QalbIT marks are trademarks of QalbIT Infotech Private Limited. You may not use these marks without our prior written permission.

9.3 Third-Party Content

PocketGST may include third-party libraries, APIs, or data sources (e.g., HSN/SAC code database, Google Drive API). Such content is the property of their respective owners and is used under license.

9.4 User-Generated Content

If you share feedback, suggestions, or other content with QalbIT (e.g., via support channels, social media), you grant us a worldwide, royalty-free, perpetual license to use, modify, and incorporate such content into the App without compensation or attribution.

10. Disclaimers and Limitations of Liability

10.1 "AS IS" and "AS AVAILABLE" Basis

PocketGST is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
Warranties that the App will be error-free, uninterrupted, or secure
Warranties regarding the accuracy, completeness, or reliability of any content or data

10.2 No Tax or Legal Advice

PocketGST is a calculation and invoice generation tool, NOT a substitute for professional tax, accounting, or legal advice. You are solely responsible for:

Ensuring compliance with GST laws and regulations
Verifying the accuracy of calculations and invoices
Filing GST returns and maintaining records as required by law
Consulting qualified chartered accountants or tax professionals for advice

QalbIT does not provide tax advisory services and is not liable for any errors, penalties, or legal consequences arising from your use of the App.

10.3 GSTIN Validation Disclaimer

IMPORTANT: PocketGST's offline GSTIN validation is for format verification only. It does NOT:

Verify that a GSTIN is active or registered with the government
Confirm the business name associated with a GSTIN
Check the real-time status with GSTN servers

You must independently verify GSTIN validity through official government channels (https://services.gst.gov.in/). QalbIT is not responsible for any errors, fraud, or losses arising from reliance on offline GSTIN validation.

10.4 Third-Party Services

PocketGST integrates with third-party services (Google Drive, Google Play Billing, Apple App Store, e-invoicing portals). QalbIT is not responsible for:

The availability, accuracy, or functionality of third-party services
Any errors, delays, or failures caused by third-party providers
Data breaches or security issues at third-party platforms
Changes to third-party terms of service or pricing
Google Drive storage limits or account issues

10.5 Limitation of Liability

To the maximum extent permitted by Indian law, QalbIT's total liability to you for any claims arising from or related to PocketGST shall not exceed the amount you paid to QalbIT in the 12 months preceding the claim, or ₹5,000, whichever is less.

QalbIT shall NOT be liable for:

Indirect, incidental, consequential, punitive, or special damages
Lost profits, revenue, data, or business opportunities
Tax penalties, fines, or legal consequences resulting from your use of the App
Damages caused by your failure to backup data or maintain account security
Data loss due to device failure, Google Drive issues, or user error
Errors or inaccuracies in GST calculations or invoices
Reliance on offline GSTIN validation
Force majeure events (see Section 13)

This limitation applies even if QalbIT has been advised of the possibility of such damages.

10.6 User Responsibility

You acknowledge and agree that:

You are solely responsible for verifying the accuracy of all calculations, invoices, and reports generated by PocketGST
QalbIT does not audit, review, or certify the correctness of your data
You must independently comply with all GST laws, filing deadlines, and regulatory requirements
You are responsible for maintaining backups of your data
You are responsible for the security of your Google Drive account (Pro tier)
QalbIT is not liable for any errors, omissions, or inaccuracies in your business records

11. Indemnification

You agree to indemnify, defend, and hold harmless QalbIT Infotech Private Limited, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use or misuse of PocketGST
Your violation of these Terms
Your violation of any applicable laws or regulations (including GST Act, Income Tax Act)
Your infringement of any third-party rights (intellectual property, privacy, etc.)
Any fraudulent or illegal activity conducted using your account
Any tax penalties, fines, or legal consequences resulting from your business activities
Data stored in your Google Drive account
Your reliance on offline GSTIN validation

This indemnification obligation survives termination of these Terms.

12. Termination

12.1 Termination by You

You may stop using PocketGST at any time by:

Uninstalling the App from your device
Canceling your Pro subscription (if applicable) — no refund will be issued
Deleting your Google Drive backups (if Pro user)
Revoking PocketGST's access to your Google Drive

12.2 Termination by QalbIT

QalbIT may suspend or terminate your access to the App immediately, without prior notice or refund, if:

You violate these Terms
You engage in fraudulent, illegal, or abusive activity
Your payment method fails and you do not update it within 7 days
Required by law or government authority
QalbIT discontinues the Service (see Section 12.4)

12.3 Effect of Termination

Upon termination:

Your license to use PocketGST is immediately revoked
Your Pro subscription (if any) is forfeited without refund
Your local data remains on your device (you may delete it manually)
Your Google Drive backups remain in your Google Drive (QalbIT does not delete them)
You must cease all use of the App and delete all copies from your devices
Sections 7 (Data Ownership), 9 (Intellectual Property), 10 (Disclaimers), 11 (Indemnification), and 14 (Dispute Resolution) survive termination

12.4 Service Discontinuation

QalbIT reserves the right to discontinue PocketGST at any time with 90 days' advance notice. In such event:

No refunds will be issued for any subscriptions (Monthly, Yearly, or Lifetime)
You will have 90 days to export your data before the App is shut down
Your Google Drive backups will remain in your Google Drive account

13. Force Majeure

QalbIT shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to:

Acts of God (earthquakes, floods, storms, pandemics)
War, terrorism, civil unrest, or government action
Internet or telecommunications failures
Power outages or infrastructure failures
Third-party service provider failures (Google Drive, Google Play, Apple App Store, GSTN servers)
Changes in GST laws or regulations requiring immediate system updates

During a force majeure event, QalbIT's obligations are suspended to the extent affected. If the event continues for more than 30 days, either party may terminate these Terms without liability (and without refund).

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms are governed by the laws of India and the laws of the State of Gujarat, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising out of or related to these Terms or PocketGST shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

14.3 Informal Resolution

Before initiating any legal proceedings, you agree to first contact QalbIT at support@pocketgst.com to attempt to resolve the dispute informally. We will work in good faith to reach an amicable resolution within 30 days.

14.4 Arbitration (Optional)

If informal resolution fails, either party may elect to resolve the dispute through binding arbitration under the Arbitration and Conciliation Act, 1996, with the following terms:

Seat of arbitration: Ahmedabad, Gujarat, India
Language: English
Number of arbitrators: 1 (mutually agreed; if no agreement, appointed by the court)
Arbitration costs: Borne equally by both parties

Arbitration awards are final and binding, subject only to limited judicial review under Indian law.

14.5 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action, consolidated action, or representative proceeding. You waive any right to participate in or bring a class action lawsuit against QalbIT.

14.6 Limitation Period

Any claims arising under these Terms must be brought within 1 year of the date the cause of action accrued. Claims filed after this period are barred.

15. Changes to These Terms

15.1 Right to Modify

QalbIT reserves the right to modify these Terms at any time. When we make changes, we will:

Update the "Last Updated" date at the top of this document
Post the revised Terms in the App and on our website
Notify you via in-app notification, email (if you have provided account email), or prominent notice in the App

15.2 Acceptance of Changes

Material changes (e.g., pricing, refund policy, liability terms) will take effect 14 days after notice. By continuing to use PocketGST after the notice period, you accept the revised Terms.

Non-material changes (e.g., clarifications, formatting, legal updates) take effect immediately upon posting.

If you do not agree to the revised Terms, you must stop using the App and cancel your subscription (no refund will be issued).

15.3 Version History

Previous versions of these Terms are available upon request at support@pocketgst.com.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and QalbIT regarding PocketGST and supersede all prior agreements, communications, and understandings (written or oral).

16.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

16.3 Waiver

QalbIT's failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future. Any waiver must be in writing and signed by an authorized representative of QalbIT.

16.4 Assignment

You may not assign, transfer, or delegate these Terms or your rights/obligations under them without QalbIT's prior written consent. QalbIT may assign these Terms to any affiliate, successor, or acquirer without your consent.

16.5 No Third-Party Beneficiaries

These Terms are for the sole benefit of you and QalbIT. No third party has any rights or standing to enforce these Terms.

16.6 Language

These Terms are drafted in English. Any translations provided are for convenience only. In case of conflict, the English version prevails.

16.7 Notices

All notices to QalbIT must be sent to:

Notices are deemed received:

Email: 24 hours after sending (if not bounced)

18. Acknowledgment

BY DOWNLOADING, INSTALLING, OR USING POCKETGST, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY UNINSTALL THE APP AND DISCONTINUE ALL USE.

YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT:

ALL SALES ARE FINAL AND NO REFUNDS WILL BE PROVIDED
GSTIN VALIDATION IS OFFLINE ONLY AND NOT A LIVE GOVERNMENT CHECK
CLOUD BACKUP IS STORED IN YOUR OWN GOOGLE DRIVE, NOT QALBIT'S SERVERS
YOU ARE SOLELY RESPONSIBLE FOR GST COMPLIANCE AND ACCURACY OF YOUR DATA
